1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Club Spark Thailand Co. Ltd ("Company", "we", "us", or "our"), concerning your access to and use of the Spark platform and services.

By accessing or using our services, you agree that you have read, understood, and agree to be bound by all of these Terms. If you do not agree with all of these Terms, then you are expressly prohibited from using the services and you must discontinue use immediately.

You may not access or use the services for any purpose other than that for which we make the services available. The services may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

Prohibited Activities

• Systematically retrieve data or other content from the services to create or compile a database or directory
• Circumvent, disable, or otherwise interfere with security-related features of the services
• Engage in unauthorized framing of or linking to the services
• Trick, defraud, or mislead us and other users
• Make improper use of our support services or submit false reports of abuse or misconduct
• Engage in any automated use of the system
• Interfere with, disrupt, or create an undue burden on the services or the networks or services connected to the services

4. User Registration

You may be required to register with the services. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

5. Fees and Payment

We accept the following forms of payment: credit cards, debit cards, and other electronic payment methods. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the services.

You further agree to promptly update account and payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed.

Sales tax will be added to the price of purchases as deemed required by us. We may change prices at any time. All payments shall be in Thai Baht (THB) or US Dollars (USD).

6. Free Trial

We offer a 14-day free trial to new users. During the free trial period, you will have access to all features of your selected plan. No payment information is required to start your free trial.

At the end of the free trial period, your access to the services will be suspended unless you choose to subscribe to a paid plan. You may cancel your free trial at any time without any obligation.

7. Cancellation

You can cancel your subscription at any time by logging into your account or contacting us at support@clubspark.site. Your cancellation will take effect at the end of the current paid term.

If you cancel your subscription, you will continue to have access to the services until the end of your current billing period. After that, your access will be suspended and your data may be deleted according to our data retention policy.

8. Intellectual Property Rights

The services and their original content, features, and functionality are and will remain the exclusive property of Club Spark Thailand Co. Ltd and its licensors. The services are protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. User Data

We will maintain certain data that you transmit to the services for the purpose of managing the performance of the services, as well as data relating to your use of the services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the services.

10. Privacy Policy

We care about data privacy and security. Please review our Privacy Policy, which also governs your use of the services, to understand our practices.

11. Termination

We may terminate or suspend your account and bar access to the services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the services or contact us at support@clubspark.site.

12. Disclaimer

The information on this website is provided on an "as is" basis. To the fullest extent permitted by law, this Company excludes all representations, warranties, conditions and terms whether express or implied, statutory or otherwise.

13. Limitation of Liability

In no event shall Club Spark Thailand Co. Ltd, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the services.

14. Governing Law

These Terms shall be interpreted and governed by the laws of Thailand. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.

15. Changes to Terms

We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Terms.

It is your responsibility to periodically review these Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the services after the date such revised Terms are posted.
